The state’s highest court has ordered the Ventura County District Attorney’s Office to explain why it charges a fee for defendants to obtain copies of the evidence against them. The California Supreme Court’s ruling last week also wiped away a Ventura appeals court’s endorsement of the district attorney’s practice of billing defendants for the information that, by law, must be supplied to them. Such fees, including photocopying costs, are charged in Ventura County as well as other California counties for documents provided to defendants and their attorneys under the information-sharing practice known as discovery. |

UPDATE: Judge blocks DA's attempt to retry Hells Angels defendant |

Ventura County Star (October 3, 2009) A Ventura County Superior Court judge has blocked an effort by prosecutors to retry the president of the Santa Barbara Hells Angels, who was found not guilty last month of three felony counts related to a road rage incident earlier this year, but the jury was unable to reach a verdict on two counts. Ventura County prosecutor Derek Malan wanted Archie Schaffer Jr., 36, retried on the counts of brandishing a weapon and reckless driving. But Judge Patricia Murphy decided Friday to dismiss the remaining charges, according to a docket report on the trial. His attorney Anthony Zinnanti said today that he plans to file a federal civil rights suit on behalf of Schaffer and his family against the prosecutor in the case, the Ventura County Sheriff and the sheriff’s gang unit. He has accused the District Attorney’s Office of having a “political agenda” against the Hells Angels. |

The following story appeared in the Ventura County Star after the jury in People v. Archie Schaffer, Jr. refused to convict and refused to find the Hells Angels Motorcycle Club to be a "criminal street gang." _______ Ventura County Star - by Raul Hernandez
A jury Wednesday found the president of the Santa Barbara Hells Angels not guilty of three felony counts and couldn’t reach a verdict on two other charges stemming from a Casitas Springs road-rage incident with five motorcyclists this year. The Ventura County Superior Court jury said Archie Schaffer Jr., 36, of Oak View was not guilty of attempted criminal threats on motorcyclist Duncan Mardling, not guilty of brandishing a gun at motorcyclist David Navarrete and not guilty of street terrorism. |

L.A. judge allows Anna Nicole Smith body to be buried |

Story note: Attorney, Anthony D. Zinnanti, appeared with James T. Neavitt on behalf of Howard K. Stern on February 9, 2007 before the Hon. Judge Robert Schnider regarding retention of Anna Nicole Smith's remains. Mr. Zinnanti handled the declaration of the serologist (blood and DNA expert). The following account, found at http://www.actressarchives.com/news.php?id=4101 is an accurate accounting of events - except with regard to who asked for what. But, that was behind closed doors in a confidential parentage proceeding. And . . . it shall remain that way. It was a very sad day but a pleasure to work with Ron and Jim, two excellent attorneys.
==================== Within hours of the tragic death of Anna Nicole Smith, various parties with vested interests in the Anna Nicole case filed lawsuits and injunctions in courts in both Florida and California. Last week, less than a day after the former Playboy Playmate and TrimSpa spokesperson died after being found in her hotel room at the Seminole Hard Rock Hotel and Casino in Florida, Larry Birkhead and his lawyer, Debra Opri, filed a request to hold the body of Anna Nicole Smith in Florida to allow for a DNA sample to be taken from her body in order to corroborate DNA paternity tests conducted on the daughter of Anna Nicole Smith, Dannielynn Stern. |

Val Zavala>> The internet has opened up a whole new forum for sex offenders. Now some sites like child pornography are, of course, criminal. But what about others? What if a pedophile simply fantasizes on the internet? Is that a crime? A judge recently issued a restraining order against professed pedophile, Jack McClellan. It was based mainly on statements he posted on his website. Tony Zinnanti is the attorney who secured the restraining order against McClellan. He joins us at our Kitchen Table for a debate with Eugene Volokh, constitutional law professor at UCLA. David Lehrer of CommUnity Advocates kicks off our debate.
